What Are the Health Reports and Medical Examination Reports to Be Obtained at Employment Entry?
Information about where to obtain reports during employment entry and medical examinations.
Why?
In Article 15 titled “Health Surveillance” of the Occupational Health and Safety Law No. 6331, employment entry health reports, medical examinations, and who will issue these reports are specified. However, when looking at Article 38 of the same law, the effective date of Article 6 regulating occupational health and safety services is arranged with a phased transition as “For public institutions and workplaces with fewer than 50 employees and classified as less hazardous, one year after the publication date (June 30, 2014).” Therefore, it aims to eliminate the confusion in the public.
How?
Since the obligation to employ a workplace physician for the mentioned workplaces has not yet started according to the Occupational Health and Safety Law No. 6331, as a result, the obligation to obtain the “health reports” in Article 5 from the workplace physician working in the workplace health and safety unit or the common health and safety unit providing services during the phased transition period has not come into effect for these workplaces.
On the other hand, according to the Ministry of Health’s Circular No. 2004/67 dated 07.05.2004 on the Issuance of Health Board Reports in Private Hospitals, it is stated that “In private hospitals; even if properly constituted, specialized reports such as disabled health board reports, tax exemption reports, overseas treatment reports, disability reports, reports obtained for the import of specially equipped vehicles cannot be issued.” Therefore, it does not seem possible for private health service providers to conduct employment entry and periodic medical examinations.
Conclusion
Until the relevant articles of the law come into force, employment entry and periodic medical examinations, especially those in the form of reports in terms of occupational health and safety, can be issued by public health service providers as before the law.
