ISIS Bulletin 49-15 Soil Pollution Activity Preliminary Information Form

What is it?

Point source soil pollution: Soil pollution caused by accidents that may occur during the collection, transportation, temporary and interim storage, recovery, reuse, and disposal of hazardous wastes, or as a result of hazardous wastes being managed in violation of the regulations specified in the legislation, or due to accidents or disasters that may occur during the storage and transportation of various hazardous chemical substances in industrial facilities, resulting in spills, leaks, and similar point source contaminations.

Activity Preliminary Information Form: A form containing information about the industrial facility and its surroundings.

Why?

According to Article 8 of the “Regulation on the Control of Soil Pollution and Point Source Polluted Sites” dated 08.06.2010 and numbered 27605, which will enter into force on 08.06.2015 (Existing operators conducting activities listed in Annex-2, Table 2, and new operators starting activities must fill out the Activity Preliminary Information Form in Annex-3 in the Polluted Sites Information System and notify the provincial directorate), businesses operating under this scope are required to submit the necessary applications to the provincial directorate.

When?

According to the first paragraph of Article 8, which will enter into force on 08.06.2015, existing operators conducting activities listed in Annex-2, Table 2 must fill out the Activity Preliminary Information Form in Annex-3 in the Polluted Sites Information System and notify the provincial directorate within three months at the latest, while new operators must do so within one month after starting the activity.

Purpose

To prevent soil pollution as the receiving environment, to identify sites and sectors where pollution exists or is likely to occur, and to determine the principles for cleaning and monitoring polluted soils and sites in a manner compatible with sustainable development goals.

Important!

Operators causing soil or groundwater pollution are responsible under Article 13, paragraph six, and Article 28 of the Environmental Law. If responsible persons causing soil pollution do not take necessary measures to stop, remedy, and reduce environmental damage, or if these measures are taken directly by authorized authorities, the expenses made or to be made by public institutions and organizations will be collected from those responsible for soil or groundwater pollution according to the provisions of the Law on the Procedure for the Collection of Public Receivables No. 6183 dated 21/7/1953.

Note: In case of any contrary practice, it is appropriate to take necessary actions to avoid legal proceedings by the Ministry of Environment and Urbanization according to the relevant law.
