What Is It?

Environmental Permit; a document to be issued for businesses under relevant legislation to protect receiving environments such as air, water, and soil.

Environmental permit opinion letter; a letter issued by the Provincial Directorate/Ministry of Environment and Urbanization indicating the determined status regarding at least one of the subjects of emission, discharge, noise control, deep sea discharge, and hazardous substance discharge, which must be obtained under the Environmental Law.

Who Must Obtain It?

All facilities listed in Annex-1 and Annex-2 of the Regulation on Permits and Licenses Required under the Environmental Law (each unit emitting to air, water, or soil; machines, tools, or other fixed installations; properties where substances are stored, unloaded, or processed) must obtain it.

How Is It Obtained? Who Issues It?

It is issued by the Ministry of Environment and Urbanization and the affiliated Provincial Directorate of Environment and Urbanization. Inspections are carried out by the Ministry of Environment and Urbanization and Provincial Directorates.

Why?

  • Environmental Inspection Regulation dated 21.11.2008, No. 27061.

  • Regulation on Environmental Officers, Environmental Management Units, and Environmental Consultancy Firms dated 21.11.2013, No. 28828.

When?

This regulation came into force on 01.04.2010.

Process and Validity

Environmental Permit / Environmental Permit and License granted to businesses is valid for 5 years.

Within this period;

  • Change of the business activity location,
  • Change of the business activity subject,
  • Change of the business fuel and/or combustion system,
  • Increase of the total production capacity of the business by at least 1/3,
  • Increase of the business's combustion / nominal thermal power by at least 1/3

If at least one of these situations occurs, the obtained permits and licenses must be renewed.
